These Terms of Service (the “Terms”) form a binding agreement between you and Aussie Car Check Pty Ltd (ABN 12 345 678 901) (“Aussie Car Check”, “we”, “us”, “our”) and govern your use of the website at aussiecarcheck.com.au and the vehicle history report service (together, the “Service”). By using the Service you accept these Terms. If you do not accept them, do not use the Service.
1. Service overview
Aussie Car Check provides on-demand vehicle history reports sourced live from the Personal Property Securities Register (PPSR) (administered by the Australian Financial Security Authority) and the National Exchange of Vehicle and Driver Information System (NEVDIS) (administered by Austroads on behalf of the state and territory road authorities). Reports include finance/encumbrance status, written-off and stolen records, registration information, vehicle identification and specifications, ANCAP safety data, common faults, and a market valuation summary.
2. Eligibility & permitted use
You must be at least 18 years old and have legal capacity to enter into these Terms. You agree to use the Service only for lawful purposes related to assessing a vehicle you intend to buy, sell, finance, insure, or otherwise have a legitimate interest in. You must not:
- Use the Service to harass, dox, or invade the privacy of any individual;
- Bulk-scrape, resell, or redistribute report data, except as expressly permitted in writing;
- Submit false information, attempt to bypass our security measures, or interfere with the Service;
- Use the Service in breach of the Privacy Act 1988 (Cth) or any other Australian law.
3. Ordering a report
An order is placed when you submit a registration number / state and complete payment via Stripe. We will then generate the report by querying PPSR and NEVDIS and email it to the address you provided. Reports are typically delivered within 60 seconds. If a delay occurs, we will notify you and may issue a refund if we cannot complete the search.
4. Pricing, payment & tax
- Price: A$19.99 (Essentials) or A$29.99 (Comprehensive) per report, inclusive of GST, unless otherwise stated at checkout.
- Payment processor: Stripe. We do not store, process, or transmit your card details.
- Currency: All prices are in Australian dollars. Foreign exchange fees, if any, are charged by your card issuer.
- Tax invoice: A GST-compliant tax invoice is provided in your report email.
5. Refunds
Because we incur a per-search fee from government databases the moment your search runs, all sales are final and non-refundable once a report has been generated. If you experience a problem — including a duplicate charge, a typo in the rego, a payment processed without a corresponding report, or a clear technical error on our side — contact support@aussiecarcheck.com.au within 7 days and we will investigate and, where appropriate, issue a refund or re-run the search at no charge. Nothing in this section limits your rights under the Australian Consumer Law (see section 8).
6. Data accuracy
The information in your report originates from third-party government databases (PPSR and NEVDIS). We do not own, manually verify, alter, or otherwise control that data. While we believe these registers to be authoritative and current, we do not guarantee that:
- The data is free of every error, omission, or delay;
- Every event affecting a vehicle (e.g. an accident not lodged with insurance) appears in the official record;
- Information remains accurate after the timestamp on your report.
A vehicle history report is one input into a buying decision and is not a substitute for a physical inspection by a qualified mechanic.
7. Limitation of liability
To the maximum extent permitted by law:
- The Service is provided on an “as-is” basis without express or implied warranties of any kind;
- Aussie Car Check is not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profit, loss of opportunity, or loss of data, arising from or in connection with your use of the Service;
- Our total aggregate liability arising out of or in connection with the Service in any 12-month period is limited to the amount you paid for the report giving rise to the claim.
8. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law or other applicable law that cannot be lawfully excluded. Where a guarantee under the Australian Consumer Law applies and cannot be lawfully excluded, our liability is limited (where permitted) to the resupply of the report or the cost of resupply.
9. Intellectual property
All trademarks, logos, content, and software on the Service are owned by Aussie Car Check or our licensors. We grant you a limited, revocable, non-transferable licence to view your reports for personal or internal-business use. You may not republish, redistribute, or commercialise our content without prior written consent. PPSR™ and NEVDIS™ are trademarks of their respective administrators and are referenced for identification only.
10. Suspension & termination
We may suspend or terminate your access to the Service if we reasonably believe you have breached these Terms, are misusing the Service, or are attempting to defraud us, our payment processor, or a government provider. We may also discontinue or modify the Service at any time, with or without notice, although we will give reasonable notice for material changes that affect existing customers.
11. Changes to these Terms
We may update these Terms from time to time. The current version is always at aussiecarcheck.com.au/terms. For material changes we will notify you via email or a prominent website notice at least 14 days before the change takes effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
12. Governing law & disputes
These Terms are governed by the laws of Queensland, Australia. The parties submit to the exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia. Before commencing any formal proceedings, the parties will attempt to resolve a dispute by good-faith negotiation. If you are a consumer, this clause does not affect any rights you may have to lodge a complaint with the relevant consumer-protection regulator.
